ACPO Scotland – Drink Drive Vehicle Forfeiture Initiative

The agencies involved are Association of Chief Police Officers in Scotland, Crown Office and Procurator Fiscal Service, Scottish Court Service, Road Safety Scotland and Scottish Government.

The initiative used legislation that had been in place since 1995, which allowed for application to the court to consider forfeiture of a vehicle used in the commission of an offence under the Road Traffic Act 1988 and which is punishable by imprisonment.  The initiative focused on drink driving offenders who had a previous conviction within the last five years.  All stakeholders agreed that to maximise the deterrent value across Scotland, the initiative had to take place across the entire country.
